Subpoena
In any proceeding, a Subpoena may be used to order that a person attend court for the purpose of giving evidence, producing any document or thing, or for both purposes.
| Notice to Addressee and Declaration - Form 42B | This form 42B is to be attached to the front of a subpoena to produce documents by the issuer. The addressee must complete the form and attach it to the subpoena or copy thereof which accompanies the documents produced to the court. |
| Subpoena - Form 42A | Use this form to compel a person or corporation to attend to give evidence or to provide documents to the court or both. A subpoena to produce documents must have attached to the front of it a Notice to Addressee and Declaration (Form 42B) |
| Subpoena for production to registrar - Form 42AA | Form to compel a person or corporation to produce documents to a registrar of the court. This form may only be used when a party has an Australian lawyer representing them in a proceeding as stated in Rule 42A.01(1). |
