Subpoena

In any proceeding, a Subpoena may be used to order that a person attend court for the purpose of giving evidence, producing any document or thing, or for both purposes.

This form 42B is to be attached to the front of a subpoena to produce documents by the issuer. The addressee must complete the form and attach it to the subpoena or copy thereof which accompanies the documents produced to the court.
Use this form to compel a person or corporation to attend to give evidence or to provide documents to the court or both. A subpoena to produce documents must have attached to the front of it a Notice to Addressee and Declaration (Form 42B)
Form to compel a person or corporation to produce documents to a registrar of the court. This form may only be used when a party has an Australian lawyer representing them in a proceeding as stated in Rule 42A.01(1).
