Civil and Money Matters

This page provides information relating to the Civil Jurisdiction of the Magistrates' Court of Victoria. The Civil Jurisdiction of the Magistrates' Court hears and determines disputes arising from claims for damages, debt or other monetary demands and for equitable relief. (See Section 100 Magistrates' Court Act 1989). The Magistrates' Court can determine most disputes over money or property up to the value of $100 000, however in certain circumstances the Court can hear cases with an unlimited value.

Cases in the Civil Jurisdiction fall into three broad categories: General, Workcover and Industrial.

 

General Civil Jurisdiction

The General Civil Jurisdiction covers matters relating to claims for debts, damages for breach, of contract, damage to property or for injury (e.g. motor car collisions) and limited neighbourhood matters, e.g. fencing disputes (see Related Page panel on the right). It also deals with applications for entry permits and civil action for alleged discrimination under the Occupational Health and Safety Act 2004 (see Related Page panel on right).

 

Industrial Division

The Industrial Jurisdiction includes claims under the Long Service Leave Act 1992 and is known as the Industrial Division of the Magistrates' Court. The Industrial Division may also hear matters arising under the Occupational Health and Safety Act 2004.  See menu on left for Industrial Division information

 

Workcover Division

The Workcover Jurisdiction deals with claims for compensation for workplace injuries either under the Workers Compensation Act 1958 or the Accident Compensation Act 1985.  See menu on left for Workcover Division information
