Warrant to Seize Property
This is the most commonly used enforcement procedure. The Sheriff is directed by the warrant document to attend at a Victorian premises where the debtor has assets. If payment is not made, the Sheriff can seize assets belonging to the debtor sufficient to satisfy the debt. The Sheriff will advise of the assets that can be seized.
The Creditor may apply to the Magistrates’ Court for the issue of a Warrant to Seize Property (Form 68A).
- The Creditor must provide an address of the Debtor within Victoria, where it is believed that property that may be seized, can be found.
- The Creditor must file at least 2 copies of the Warrant with the Court, together with the filing fee, for issue.
- The issued warrant will be returned to the Creditor.
- The issued warrant must then be forwarded to the Sheriff’s Office at:
