Obtaining Judgment on your Complaint

If the Defendant has not lodged a notice of defence with the court and you or your solicitor within 21 days of being served, the Plaintiff may obtain a default judgment. This means that you may obtain judgment on your case by filing certain documentation, and generally means no hearing of the matter will be required.

A default judgment is obtained by filing with the Court:

  • Form 21A – Application for Order in Default of Defence.
  • Form 6A Affidavit of Service; and,
  • In some circumstances, an Affidavit will be required to verify the amount that you have claimed in your complaint
  • Required certification forms (if they have not already been filed)

A Magistrate or Registrar may enter judgment for the amount of the claim plus the costs incurred for issuing and service.

The Court will provide a copy of the order to you once judgment is entered.
